My practice consists of dispute resolution through mediation, arbitration and litigation in state and federal courts. I concentrate primarily in the substantive areas of real estate, bankruptcy, commercial contract, business torts, insurance, intellectual property, and appellate advocacy, representing both plaintiffs and defendants.

Thompson v. Insurance Management Associates (Denver District Court, Colorado Supreme Court). Representation of land developer in insurance breach of contract and attorney professional liability action arising from damaging results of previous underlying litigation over property dispute in Jefferson County, Colorado. Professional liability claims successfully settled and insurance breach of contract claims resolved by Colorado Supreme Court.
The Ridge at Hiwan v. Hiwan Ridge Development Company and Thompson (Colorado Court of Appeals; Jefferson County District Court on retrial). Successful representation of land developer, Chapter 11 debtor-in-possession, in state court appeal, reversal and retrial of $2.6 million judgment originally entered against client in underlying property dispute litigation in Jefferson County, Colorado.
Gamlestaden, Ltd. v. Lindholm (U.S. District Court, Colorado). Successful representation of multiple defendants in $51 million action brought under federal RICO statute and state law, involving claims arising from earlier financial collapses in European shipping industry.
Christensen v. Lu (Denver District Court; Colorado Court of Appeals). Successful representation of plaintiff client in claim to ownership share of multi-million dollar Colorado Lottery prize. Favorable jury verdict and implementing judgment affirmed by Colorado Court of Appeals.
Energy Conservation Products, Co. v. City and County of Denver and Utilicorp Energy Solutions, Inc. (Denver District Court). Successful defense of client City and County of Denver in dispute concerning large natural gas purchase contracts.
Steadman v. Plath Construction, Inc. (Boulder County District Court). Successful representation of plaintiff inventor in dispute with co-inventors and corporate employer regarding patent rights to innovative roofing shingle.
American Pacific Properties, Inc. v. Colorado Housing and Finance Authority (American Arbitration Ass'n). Successful defense of client Colorado Housing and Finance Authority in arbitration over authority's administrative and quasi-judicial power in allocating federal low income housing tax credits.
Mountain States Bank v. The Clayton Foundation (Denver District Court). Successful defense of client charitable foundation, owner of golf course property, in dispute with bank over responsibility for repayment of loans made to golf course operator/tenant.
Sterrett v. Post (Eagle County District Court; Colorado Court of Appeals; Colorado Supreme Court). Represented landowner in multi-issue property dispute involving boundary conflicts, adverse possession claims, and private easement and statutory public road claims involving 22,000 acre ranch in Eagle County, Colorado.
Horizon Surgical, Inc. v. Teleflex, Inc. (U.S. District Court, Colorado). Obtained litigated preliminary injunction and stipulated permanent injunction for client against hostile competitor in connection with re-manufacture of surgical ligating clip appliers in violation of Lanham Act.
Centennial Aspen II Limited Partnership v. City of Aspen, County of Pitkin, Colorado and Aspen/Pitkin County Housing Authority (U.S. District Court, Colorado). Obtained $500,000 judgment and long-term stipulated supplemental relief for client in dispute with local government entities concerning client's right to periodically increase rents in area's largest rent-regulated affordable housing complex constructed in cooperation with local governments.
In re: Kaiser Steel Corporation, Debtor: Kaiser Steel Corporation, Inc. v. Pearl Brewing Co. (U.S. Bankruptcy Court, Colorado; U.S. District Court, Colorado; Tenth Circuit Court of Appeals; U.S. Supreme Court). Represented two principal shareholder defendants (Falstaff Brewing Company and Pearl Brewing Company) in successful defense of Chapter 11 debtor's fraudulent conveyance challenge to $162 million leveraged buy-out of shareholders of Kaiser Steel.
Lobato v. Taylor (Costilla County District Court; Colorado Court of Appeals; Colorado Supreme Court; U.S. Supreme Court). Trial and appellate co-counsel for large class of Costilla County property owners seeking validation of claims, arising from Mexican land grant, to use rights over 80,000 acre private landholding in Southern Colorado known as the Taylor Ranch. Rights validated by Colorado Supreme Court, and certiorari denied by U.S. Supreme Court.
Colorado Common Cause v. Davidson (Denver District Court) challenged several aspects of Colorado's election laws and Secretary of State's election rules prior to 2004 general election. Obtained injunctive relief insuring that absentee ballots would be properly counted.
Whitfield v. Board of Commissioners of Eagle County, Colorado (U.S. District Court, Colorado; Tenth Circuit Court of Appeals). Obtained $800,000 settlement and injunctive relief in class action on behalf of victims of alleged illegal "drug interdiction" traffic stops and seizures of random motorists by Eagle County sheriff's officers.
Sanchez v. State of Colorado and Colorado Reapportionment Commission (U.S. District Court, Colorado). Acted as litigation consultant in Federal Voting Rights Act case challenging 1992 redistricting of Colorado House of Representatives as it affected Colorado's San Luis Valley.
