David Fine continues to handle matters involving professors at higher education institutions. David represented a professor at Colorado State University in a disciplinary matter and represented another Colorado State University professor in connection with legal questions surrounding his tenure application. David continues to represent a prominent neurosurgeon related to his tenure at the University of Colorado Health Sciences Center in litigation in Denver District Court involving the neurosurgeon, the Health Sciences Center, University Hospital and other neurosurgeons.
Freddie Alvarez obtained a judgment for treble damages and attorney fees in a case before Judge Thomas R. Ensor in Adams County District Court. Freddie's clients had invested funds into the construction of a housing development of which the developers failed to honor the contractual agreement.
The Denver Water Department has retained Woody Garnsey as lead trial counsel in the defense of a federal court employment case alleging illegal sex and age discrimination. The case is expected to be tried sometime in the Fall of 2006.
Freddie Alvarez participated as an arbitrator in another NASD arbitration panel that issued final orders. Freddie has now issued arbitration awards in the following types of cases: consumer; contract on sale of business; employment; franchise termination; healthcare insurance coverage; residential real estate: homeowner/home builder, homeowner/remodeler; securities; telecommunications; and underinsured motorist cases.
Steve Lass, Kate Swan and Susan Raiser recently completed the trial of a dissolution of marriage case involving complex claims that the opposing party had improperly depleted the marital estate.
Ed Kahn settled a defense case involving alleged sexual harassment by a 7th and 8th grader in federal court. Ed is not actively taking on new litigation matters but is mediating and arbitrating as a neutral.
Freddie Alvarez and Kate Swan recently settled child custody dispute between a mother who relocated to Colorado with her days-old son after her husband left her alone and weak from childbirth to care for the infant for several days, and a father, who remained in New York following the mother's relocation to Colorado. The dispute centered on the propriety of mother's move under the circumstances and on whether she could be required to return to New York for purposes of determining parenting time and decision making responsibility.
David Fine represented a client in the pipeline construction business in an administrative proceeding before the Federal Aviation Administration ("FAA") related to the shipment of hazardous materials. David was able to achieve a substantial reduction in the penalty the FAA initially proposed to assess against the client.
Freddie Alvarez had a successful appeal to obtain the reversal of several orders entered by a Magistrate in the Denver District Court against his client in an international family law case. The orders were reversed by the District Court Judge Anne Mansfield on grounds that the magistrate had lost jurisdiction after the parties left Colorado.
Steve Lass continues to be a member of the Metropolitan Conciliation Panel. The Panel consists of a diverse group of metropolitan Denver lawyers who have a reputation for high integrity and professionalism. Panel members volunteer their time to address breaches of professionalism between lawyers. The panel strives to increase professionalism and civility among lawyers as exemplified in the Denver Bar Association's "Principles of Professionalism."
Kate Swan has been selected to serve on the steering committee of the Young Advocates Network, a project to increase the involvement of younger lawyers (associates and junior partners) in the activities of the Colorado Lawyers Committee. Kate has also been selected to participate in the Downtown Denver Partnership's leadership program. The Program is an intense immersion in urban issues, policies and practices, and involves a project that challenges the participants' ability to research, analyze and collaborate. The project for 2006 will look at one aspect of the Downtown Area Plan, specifically the connectivity issues between Downtown Denver and the Auraria Higher Education Campus.
