We've had some interesting cases this quarter. Recent victories are highlighted below. We are proud of our track record in court, but by giving these examples we do not mean to imply that we
win every time.
David Fine, Martha Tierney, Ed Kahn and Christy Murphy continue to be intimately involved with the litigation over the state legislature's attempt at a second congressional redistricting.
Following the Colorado Supreme Court's decision prohibiting the General Assembly's attempt to redistrict a second time on one decade, the General Assembly, Governor Owens and the Secretary
of State attempted to have a three-judge federal panel overturn the Colorado Supreme Court's decision. Following extensive briefing and a lengthy oral argument, the panel
refused to disturb the state court decision.
Steve Lass and Martha Tierney successfully resolved a case involving multiple real estate development businesses and a collection of high performance sports cars.
David Fine and Martha Tierney are pursuing a section 1983 excessive force lawsuit against the City of Durango on behalf of a former Ft. Lewis college student who was beaten by Durango and Farmington
New Mexico police at a college party in 2001.
Martha M. Tierney successfully represented a party in Denver District Court wherein the principal issue in the case involved an interpretation of Islamic Sharia law.
Steve Lass and Freddie Alvarez successfully resolved a dissolution of marriage case involving the valuation of both an established and a start-up professional chiropractic practice, as well as
commercial real estate owned by those pratices.
David Fine is advising the Colorado Housing and Finance Authority on the regulations on accessibility in design and construction of affordable housing. David gives fair housing and related advice
to clients on an ongoing basis.
David Fine gave an update of the law on sovereign immunity in the employment area and the individual liability of managers and supervisors at a seminar sponsored by the Council on Education
in Management.
Freddie Alvarez was appointed as co-chair of his Police Task Force by Denver Mayor John Hickenlooper. The Police Task Force includes community, law enforcement and city officials. The Police
Task Force will review the Administration's proposals regarding the Denver Police Department's Use of Force Policy and its Civilian Oversight and is to recommend appropriate changes to Mayor
Hickenlooper after a 90 day review.
Steve Lass is in the middle of his tenure as Chair of the Family Law Section of the Colorado Bar Association. The Section consists of more than 800 attorneys committed to enhancing the practice
of family law in Colorado. The Section provides a forum for the education of, and communication among, family law practitioners, judges, elected officials, the state bar association, and members
of the public. During the past quarter, Steve chaired a Section "task force" preparing a detailed critique of proposed Rule of Civil Procedure 16.2 to the Colorado Supreme Court Standing Committee
on Family Issues. Steve is also serving on an Advisory Council looking at problems that have developed with the collection of child support by private debt collection agencies.
Jim Hubbell continues to spend significant time working with the Bell Policy Center in connection with its efforts to reform the TABOR Amendment.
Freddie Alvarez has been added to the American Arbitration Association's list of neutrals available to arbitrate employment cases. Freddie has already been arbitrating commercial cases through
the American Arbitration Association.
Martha Tierney was made a partner effective January 1, 2004.

Ms. Tierney comes to Kelly|Haglund|Garnsey + Kahn by way of Spain, where her forebear El Capitan Juan Diego Maria Hernandez served in King Phillip II's Royal Navy. Capitan Hernandez' warship
was part of the Spanish Armada that had a bit of a bad time of it, coming apart off the west coast of Ireland in 1588. Hernandez made it to shore, dated around, married and gradually experienced
the Gaelicizing of his name to Tir an Fhia, and the Anglicizing to Tierney. The English never came looking for Hernandez or his descendants because there is nothing in that part of Ireland
except rocks. Ms. Tierney's mother is a Fallon. The Fallons come from Athlone, a prosperous village in middle Ireland, holding a school, a funeral parlor, twenty-two pubs, a right church and
a wrong church. We welcome Martha Moore Tierney, she with the wind to her back.
Ed Kahn donates attorney time to the Colorado Center on Law and Policy. Ed also serves on several Colorado Lawyers Committee task forces, including TABOR reform, Medicaid Disability Screening
and Indigent Health Care. He also continues to serve on the board of directors of the Colorado Consumer Health Initiative.
KHGK participated in the Denver Department of Human Services Adopt-a-Family program by adopting 9 families over the holidays. |
